From: Drake Wilkerson, Inspector General<\/span><\/p>\n CC: Gerald Newsome, Bureau Chief, Monroe County Sheriff\u2019s Department; Office of Internal Affairs; Office of Human Resources<\/span><\/p>\n Subject: Review of Employee Investigation<\/b><\/p>\n On 21 April 2022, the Office of the Inspector General of the Monroe County Sheriff\u2019s Department received a tip in the Whistleblower Inbox from a female Police Officer in a neighboring department regarding Lt. Danielle Holdermen. The tip stated that the Officer, who knows Lt. Holdermen is employed by the Monroe County Sheriff\u2019s Department, viewed Lt. Holdermen on a pornographic website. The Police Officer stated that it reflected poorly on the Sheriff\u2019s Department to have one of its deputies in \u201csuch lewd poses and exposing herself online.\u201d<\/span><\/p>\n Following up on the tip, I reviewed the website to determine whether or not Lt. Holdermen was on the website, posing as was accused. I verified that images of Lt. Holdermen were on the site. She was naked, exposing her face and entire body. In addition, one or more of the images appear to have been taken in public places. The locations could only be assumed based on the image. No further action was taken to determine if, in fact, the images were taken in public.<\/span><\/p>\n On 29 May 2022, Janice Foster, Deputy Inspector General for Investigations in the Office of the Inspector General, and I interviewed Lt. Holdermen regarding the accusations from the Whistleblower and offered an opportunity to respond to the tip and images on the website.<\/span><\/p>\n Below is the transcription of the interview.<\/span><\/p>\n In addition, attached are several images of Lt. Holdermen.<\/span><\/p>\n Transcription:<\/span><\/p>\n Wilkerson: \u201cThank you for coming, Lt. Holdermen. Please have a seat.\u201d<\/span><\/p>\n Holdermen: \u201cAppreciate it. What is this all about, may I ask?\u201d<\/span><\/p>\n Wilkerson: \u201cFirst, let me introduce myself and my colleague. I am Drake Wilkerson, the Inspector General for the Department, and this is Janice Foster. She is the deputy IG. Our jobs are to\u2014\u201d<\/span><\/p>\n Holdermen: \u201cI understand your roles. It\u2019s nice to meet you both. But why am I here?\u201d<\/span><\/p>\n Foster: \u201cIt is nice to meet you too.\u201d<\/span><\/p>\n Wilkerson: \u201cFor legal purposes, I want to tell you that this meeting is being recorded.\u201d<\/span><\/p>\n Holdermen: \u201cOk.\u201d<\/span><\/p>\n Wilkerson: \u201cFor the record, would you say your name to confirm we are speaking with the correct deputy? It\u2019s, you know, a legal technicality.\u201d<\/span><\/p>\n Holdermen: \u201cHoldermen. Lieutenant Danielle Holdermen.\u201d<\/span><\/p>\n Wilkerson: \u201cDo you go by any other names?\u201d<\/span><\/p>\n Holdermen: \u201cDanni, by my family.\u201d<\/span><\/p>\n Wilkerson: \u201cNo other aliases?\u201d<\/span><\/p>\n Holdermen: \u201cUh, no.\u201d<\/span><\/p>\n Wilkerson: \u201cPublic usernames?\u201d<\/span><\/p>\n Holdermen: \u201cNo.\u201d\u00a0<\/span><\/p>\n Wilkerson: \u201cThank you. Do you know why you have been requested to be here, ma\u2019am?\u201d<\/span><\/p>\n Holdermen: \u201cNot exactly. I haven\u2019t been told much of anything. It\u2019s been confusing and very disappointing. I expect to get some clarification from both of you this afternoon. Very soon.\u201d<\/span><\/p>\n Wilkerson: \u201cI apologize that you have felt confused. It was the best way to keep a tight lid on the situation. Human resource investigations\u2014I mean, issues\u2014can arouse interest and spread quickly in an organization. You, no doubt, understand what I mean. It has happened before in previous circumstances.\u201d<\/span><\/p>\n Foster: \u201cYes, this is not an atypical approach. It has helped in previous investigations.\u201d<\/span><\/p>\n Holdermen: \u201cInvestigation? What am I being \u2018investigated\u2019 about? I don\u2019t believe I\u2019ve disregarded my duties as a deputy.\u201d<\/span><\/p>\n Wilkerson: \u201cThis all began from a tip. The Department received a tip in the Whistleblower Inbox about a month or so ago.\u201d<\/span><\/p>\n Holdermen: \u201cWhistleblower?\u201d<\/span><\/p>\n Wilkerson: \u201cCorrect, a whistleblower.\u201d<\/span><\/p>\n Holdermen: \u201cWhat was this tip all about?\u201d<\/span><\/p>\n Wilkerson: \u201cThe tip claimed you have a second job of a\u2014how would I describe it?\u201d<\/span><\/p>\n Foster: \u201cOf a sexual nature.\u201d<\/span><\/p>\n Wilkerson: \u201cYes. If we may be so blunt.\u201d<\/span><\/p>\n Holdermen: \u201cWhat?\u201d<\/span><\/p>\n Foster: \u201cDrake, I can read the specifics, so Ms. Holdermen knows exactly\u2014\u201d<\/span><\/p>\n Holdermen: \u201c\u2018Lieutenant,\u2019 if you please. I prefer Lieutenant Holdermen. I\u2019ve worked with this department for nearly two decades. I think I\u2019ve earned the rank and title. And want to be addressed as such.\u201d<\/span><\/p>\n Wilkerson: \u201cYes, you have earned the title. We will refer to you as requested. I mean you have been with the department for a long time with very good employee reviews and high performance ratings. Your work has been impressive, which makes this all the more problematic.\u201d<\/span><\/p>\n Holdermen: \u201cCan you explain the tip you got? I have been investigated, from what I\u2019ve gathered so far, and I should understand the allegations.\u201d<\/span><\/p>\n Foster: \u201cI will read the tip, word for word. I have it printed out right here on this sheet of paper. Lieutenant Holdermen, the tip\u2014\u201d<\/span><\/p>\n Holdermen: \u201cI want a copy, so I can see it. So I can read along.\u201d<\/span><\/p>\n Wilkerson: \u201cWe cannot provide the copy we have.\u201d<\/span><\/p>\n Foster: \u201cFor legal reasons.\u201d<\/span><\/p>\n Wilkerson: \u201cBecause it includes additional details that should be blacked out. Thus may expose the Whistleblower, which is against Department policy and State regulations. The Whistleblower, she included her name in the tip, so we have decided to keep the name redacted.\u201d<\/span><\/p>\n Holdermen: \u201cShe?\u201d<\/span><\/p>\n Wilkerson: \u201cJanice, you can read it aloud.\u201d<\/span><\/p>\n Holdermen: \u201cHold on. This is an accusation against me, that very well may impugn my character\u2014professionally and personally. In all ways. And forever.\u201d<\/span><\/p>\n Wilkerson: \u201cThis tip and any investigative actions conducted, to date, have been completed anonymously. No names\u2014legal names\u2014have been used. We have been extremely discreet and judicious. We do not want this to go beyond those who must know, or should know.\u201d<\/span><\/p>\n Holdermen: \u201cI can call for a lawyer if I am not provided what I request in this \u2018investigation.\u2019 In this \u2018interview\u2019 or whatever you want to call it in your legal mumbo-jumbo.\u201d<\/span><\/p>\n Wilkerson: \u201cThe best we can do right now is read the tip aloud.\u201d<\/span><\/p>\n Foster: \u201cThe tip states: \u2018I saw\u2014\u201d<\/span><\/p>\n Holdermen: \u201cI want to see a copy, to hold it so I can see that we\u2019re reading the same text.\u201d<\/span><\/p>\n Wilkerson: \u201cJanice, do you have another copy of it?\u201d<\/span><\/p>\n Foster: \u201cI can make one.\u201d<\/span><\/p>\n Wilkerson: \u201cGo, make a copy. Then, can you black out the name with a permanent marker? I think that should do in keeping the Whistleblower anonymous. Think so?\u201d<\/span><\/p>\n Foster: \u201cIt should. Let me get a marker.\u201d<\/span><\/p>\n Wilkerson: \u201cThank you. Black out both sides of the paper. Lt. Holdermen, we will provide you a copy, as asked, with the name of the officer blacked out. That should suffice in meeting your request and our regulations.\u201d<\/span><\/p>\n Foster: \u201cHere you go, Drake. And a copy for you, Lt. Holdermen.\u201d<\/span><\/p>\n Wilkerson: \u201cPlease continue reading, Janice.\u201d<\/span><\/p>\n Foster: \u201cSure. The tip states: \u2018I saw one of your deputies on a porn site. Deputy Holdermen was completely naked and in lewd poses. I think it puts the sheriff\u2019s department in a bad light. Having an employee who anyone can see naked is not good for the Sheriff, for the county\u2019s employees, and for law enforcement in general. Signed.\u2019 I will not state the name.\u201d\u00a0<\/span><\/p>\n Wilkerson: \u201cLt. Holdermen, that is what we received. Since then, Janice and I have gone to the site and verified the accusation. After searching, we found a person who goes by the name of \u2018Kelli Tois\u2019. We did not want to assume too much beforehand. I also have several pictures here, so you can confirm that these are, in fact, you. You know, doppelgangers. All this would then be a misunderstanding.\u201d<\/span><\/p>\n Holdermen: \u201cOh, my god. How did \u2026 When \u2026\u201d<\/span><\/p>\n Wilkerson: \u201cSo you are confirming that you are the female in these images.\u201d<\/span><\/p>\n Holdermen: \u201cYes. It is me.\u201d<\/span><\/p>\n Wilkerson: \u201cWould you please explain these images? They seem to have been taken willingly. And posted on the Internet.\u201d<\/span><\/p>\n Holdermen: \u201cThey were uploaded to a paying website, not just any site where anyone can get to them. Googling my proper name would not bring up the site. People pay for access to the page and the images. They have to pay more to get videos. Not just anyone can see them.\u201d<\/span><\/p>\n Foster: \u201cWhoever pays can see them though, right?\u201d<\/span><\/p>\n Holdermen: \u201cI guess so. I do have the right to deny any payer or anyone who wants to pay for access.\u201d<\/span><\/p>\n Wilkerson: \u201cDo you understand that the Department, and State government overall, has a law that requires state employees to disclose additional, or supplemental, means of income?\u201d<\/span><\/p>\n Holdermen: \u201cNo.\u201d<\/span><\/p>\n Wilkerson: \u201cIt\u2019s the Moonlighting Rule.\u201d<\/span><\/p>\n Foster: \u201cYes, the law says, essentially, that if a state employee wants to hold another job, like providing consulting services to an insurance firm by an employee of the State\u2019s Department of Insurance, the employee must receive prior approval.\u201d<\/span><\/p>\n Holdermen: \u201cHaha. What I am doing is not providing consulting services. In no way. It\u2019s for fun. Nothing more.\u201d<\/span><\/p>\n Wilkerson: \u201cThe regulation is not simply related to consulting or insurance. And not every \u2018afterhours\u2019 job is impacted by this Moonlighting Rule. I mean, a trooper can work in a bookstore, say, on the weekends, for example. However, there is also another aspect. Janice.\u201d<\/span><\/p>\n Foster: \u201cYes, the statue reads: a state employee may not \u2018accept other employment involving compensation of substantial value if the responsibilities of that employment are\u2014\u201d<\/span><\/p>\n Holdermen: \u201cWait, wait, wait. Let me stop you there. This \u2018job\u2019, as you might call it, does not include \u2018a compensation of substantial value.\u2019 Taking pictures and shooting video would, in no way, be considered a \u2018substantial\u2019 amount. Haha. In no way. Not in any way. It all began out of fun and has continued that way.\u201d<\/span><\/p>\n Wilkerson: \u201cMaybe so, but the rule brings up more issues. Janice.\u201d<\/span><\/p>\n Foster: \u201cI\u2019ll begin again. The Moonlighting Rule states, in part: a state employee cannot \u2018accept other employment involving compensation of substantial value if the responsibilities of that employment are inherently incompatible with the responsibilities of public office or require the individual\u2019s recusal from matters so central or critical to the performance of the individual\u2019s official duties that the individual\u2019s ability to perform those duties would be materially impaired.\u2019\u201d<\/span><\/p>\n Wilkerson: \u201cDo you see the issue?\u201d<\/span><\/p>\n Holdermen: \u201cNo, I don\u2019t.\u201d<\/span><\/p>\n Foster: \u201cOur concern centers around the language \u2018if the responsibilities of that employment are inherently incompatible with the responsibilities of public office.\u2019\u201d<\/span><\/p>\n Wilkerson: \u201cIt all hinges on that point. You are a representative of the State government, of the Monroe County Sheriff\u2019s Department. Your reputation in the community rests on how you present yourself in front of people.\u201d<\/span><\/p>\n Foster: \u201cWhether said people are in person or online, live online or otherwise, watching a recorded video of you masturbating with that long pink, er\u2014or looking at you bent over the hood of the General Lee while dangling your red-white-and-blue bikini bottoms in the air.\u201d<\/span><\/p>\n Holdermen: \u201cSo, Janice, those two stood out to you. Any others?\u201d<\/span><\/p>\n Foster: \u201cDeputy Inspector General Foster, if you please.\u201d<\/span><\/p>\n Holdermen: \u201cYes, ma\u2019am. You\u2019ve earned the title. How long have you been with the department?\u201d<\/span><\/p>\n Foster: \u201cNot that it matters how long before we earn our titles, but I have been here eleven years.\u201d<\/span><\/p>\n Wilkerson: \u201cLet\u2019s continue, please. The Moonlighting Rule also states that, \u2018Only a written opinion from the State Ethics Commission can provide conclusive proof that an individual\u2019s outside employment does not violate this rule.\u2019 In speaking with the chairman of the Commission, she said this sort of secondary employment would not fly. The Commission would never give such approval. So we stand at a crossroads, Lt. Holdermen. How do we proceed? That is the question.\u201d<\/span><\/p>\n <\/p>\n \u201cWell, Danielle, that\u2019s my report so far. What do you think?\u201d Drake lifted his heavy mug of dark beer, topped with a thick froth.<\/span><\/p>\n She pulled the report across the table to her and scanned it once more. She pursed her lips, and then shook her head. \u201cIt will definitely get me in trouble. I don\u2019t want Sheriff Langford to see it.\u201d<\/span><\/p>\n \u201cAnd I have more of the interview to transcribe\u2014the interview lasted two hours or so\u2014and that additional transcript would be required in the report. The IG\u2019s Office prides itself on giving a complete view of any and all of its investigations.\u201d<\/span><\/p>\n \u201cWould the report and transcript be made public record?\u201d Danielle asked.<\/span><\/p>\n \u201cIt would be, but technically, information would be limited to the general public since you are a State employee and it\u2019s somewhat of a human resources issue. No doubt though, I would release it to the newspapers and TV news stations as a leaked document. And I would suggest to Rich to be blunt with the media, giving out the details as the story advances. In the name of full transparency.\u201d<\/span><\/p>\n Janice jumped in. \u201cThe choice is yours on how we proceed, Danielle.\u201d She grinned behind her stemmed glass of dark red Cabernet Sauvignon.<\/span><\/p>\n
